Introduction

Thank you for taking interest in my art!
To make the commission process as smooth as possible, it is important that You (the Client) enter an agreement with Me (the Artist LikoSWF) as described in this terms of service.

Commission Process

Discussion phase

  1. After you initiate contact with me, we will discuss the specifications and requirements for the commissioned artwork.
  2. You will need to provide me with the necessary written details or visual aids. (such as your character reference sheet)
  3. Once you and I have agreed on the project details, I will give you a quoted price.
  4. You must pay me a deposit of at least 50% the quoted price or in full to begin the artwork commission.

Drafting phase

  1. I will start work on the draft of the artwork and provide you with regular progress updates.
  2. You may request changes and revisions to the draft at any point during the drafting phase.
  3. Once you confirm the draft, you are required to have payed the quoted price in full to continue to the detailing phase.

Detailing phase

  1. Once detailing has begun, only minor edits or adjustments will be permitted.

Payment

A deposit of at least 50% the quoted price must be payed upfront to confirm and start the artwork commission.

Refunds or cancellation

A partial refund may only occur when cancelling your commission during the drafting phase, whereby any amount paid above the minimum deposit of 50% will be refunded. Once you have confirmed the draft, refunds are no longer possible.

Termination

Termination by the client:

you may cancel your commission at anytime by sending me a written notice stating your cancellation. see refund policy

Termination by the artist:

I may cancel the commission if you breach this service agreement or you fail to communicate/respond within a 30 day time frame.

By agreeing, you acknowledges that you have read, understood, and agree to be bound by the terms and conditions outlined above.

II. Commission Process

B. Artwork creation
1. Timelines: The artist will provide the customer with an estimated timeline for the creation of the artwork, which may be subject to change due to unforeseen circumstances.
2. Progress updates: The artist will provide the customer with regular updates on the progress of the artwork.
3. Revisions: The customer may request revisions to the artwork, which the artist will provide within a reasonable timeframe.
4. Approval process: Once the artwork is complete, the artist will provide the customer with a digital proof of the artwork for approval before it is finalized.
C. Final product delivery
1. Shipping or delivery method: The artist will deliver the final artwork to the customer in a mutually agreed upon manner.
2. Copyright ownership and licensing: The artist retains all copyrights to the artwork, unless otherwise agreed upon in writing.

III. Payment
A. Payment structure: The customer will pay [Payment Amount] to the artist as an initial deposit, with the balance due upon completion of the artwork.
B. Late payments: Late payments will incur a penalty fee of [Penalty Amount] per day.
C. Refunds and cancellations: All sales are final, and no refunds will be issued once the artwork has been approved by the customer.

IV. Intellectual Property Rights
A. Ownership of the artwork: The artist retains all intellectual property rights to the artwork, unless otherwise agreed upon in writing.
B. License of the artwork: The customer is granted a non-exclusive, non-transferable license to use the commissioned artwork for personal purposes only.
C. Use of the artwork: The customer may not use the commissioned artwork for commercial purposes without the artist's express written permission.

V. Warranties and Representations
A. Artist warranties: The artist warrants that the commissioned artwork is original and does not infringe upon any third-party intellectual property rights.
B. Customer representations: The customer represents that they have the legal right to commission the artwork and that the artwork will not infringe upon any third-party intellectual property rights.
C. Limitations of liability: The artist's liability is limited to the amount paid by the customer for the commissioned artwork.

VI. Dispute Resolution
A. Dispute resolution process: Any disputes arising from this agreement will be resolved through mediation or arbitration in accordance with [State/Country] law.

VII. Termination

B. Termination by the artist: The artist may terminate the commission at any time if the customer breaches this agreement or fails to pay the balance due upon completion of the artwork.
C. Effect of termination: Upon termination, the customer will forfeit any rights to the commissioned artwork, and the artist will retain ownership and all intellectual property rights to the artwork.

VIII. Miscellaneous Provisions
A. Force majeure: Neither party will be liable for any delay or failure to perform its obligations under this agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, or natural disasters.
B. Entire agreement: This agreement constitutes the entire understanding between the parties and supersedes all prior agreements and understandings, whether written or oral.
C. Amendments and modifications: This agreement may only be amended or modified in writing, signed by both the customer and the artist.
D. Notices: All notices required or permitted under this agreement will be in writing and sent to the address or email address specified by the parties.

By agreeing to the terms of this agreement, the customer acknowledges that they have read, understood, and agreed to be bound by the terms and conditions outlined herein.
